3.1 Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our services.
3.2 Client Responsibilities
- Provide accurate and complete information necessary for service delivery.
- Ensure timely communication and cooperation to facilitate service implementation.
- Use our services only for lawful purposes and in compliance with these Terms.
4. Payment Terms
- All fees and charges for services will be detailed in the invoice or agreement.
- Payments must be made within the specified timeframe mentioned in the invoice.
- Late payments may incur additional charges or interest as permitted by law.
5. Intellectual Property
- All intellectual property rights, including but not limited to software, designs, and documentation created by Kushwaha Enterprises, remain the property of the Company unless otherwise agreed in writing.
- Clients are granted a non-exclusive, non-transferable license to use the deliverables for their internal business operations.
6. Confidentiality
- Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement.
- Neither party shall disclose such information to third parties without prior written consent, except as required by law.
7. Limitation of Liability
- Kushwaha Enterprises shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
- Our total liability shall not exceed the fees paid by the Client for the specific service that gave rise to the claim.
8. Warranties and Disclaimers
- Kushwaha Enterprises provides services "as is" and does not guarantee uninterrupted or error-free operation.
- We disclaim all warranties, express or implied, including fitness for a particular purpose or non-infringement.
9. Termination
- Either party may terminate the agreement with written notice if the other party breaches any material term of these Terms and fails to remedy the breach within a reasonable period.
- Upon termination, the Client must pay for all services rendered up to the date of termination.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab.
11. Amendments
Kushwaha Enterprises reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website or notification to the Client.
